Market Rules & Terms

By accessing, registering for, or using any services provided by the CargoXchangeSA platform, you acknowledge that you have read, understood, and agree to be legally bound by these terms. Your continued use of the platform means you accept these terms. If you do not agree, you are not allowed to use the platform. The contracting legal party is DAVIDSOLOMON (Pty) Ltd.

In this document, 'Platform' means the CargoXchangeSA web and mobile apps operated by DAVIDSOLOMON (Pty) Ltd. 'User', 'you', and 'your' mean any person or business using the platform. 'Carrier' means a transporter of goods. 'Shipper' means a person or business that sends goods. 'Broker' means someone who posts loads for clients.

Users must keep their account verified to use the platform. This means keeping your business documents and ID information up to date at all times.

CargoXchangeSA is a technology platform and not a logistics company or truck owner. We provide a professional digital system to reduce the risks of using unverified groups like WhatsApp or Facebook, giving you a safe place to find and manage transport.

Our job is to help you connect, provide a clear record of the trip, and manage safe payments. We do not own or touch the cargo at any point.

As a technology provider, CargoXchangeSA is not responsible for the physical transport. This includes things like truck breakdowns, driver behavior, or the route taken.

Under South African law, all messages sent through the platform are considered received once they arrive on your phone or dashboard.

When you click 'Accept', 'Award', 'Book', or 'Sign' on the platform, it counts as a legal signature under South African law. These actions create binding contracts between you and the other party.

Any price you offer on the platform is valid for 48 hours or until the job is given to someone else.

Once a job is booked and awarded, it is a final agreement. You cannot cancel without facing platform penalties.

When a job is awarded, the system creates a digital agreement. Both the Shipper and Transporter must sign this before the truck is assigned.

To the extent allowed by law, DAVIDSOLOMON (Pty) Ltd is not liable for indirect losses, such as lost profit or lost cargo. OUR TOTAL LIABILITY IS LIMITED TO THE VALUE OF THE SERVICE FEE COLLECTED BY THE APP FOR THE SPECIFIC TRIP IN QUESTION.

The Shipper promises they own the goods or have permission to move them, and that the cargo description is 100% correct.

You must clearly mark dangerous goods with the correct codes. If you don't declare them properly, the Transporter is not responsible for any loss.

The Shipper is responsible for making sure goods are packed safely and that the weight is correct. Overweight loads are the Shipper's responsibility.

Shippers must make sure their sites are safe for trucks and tell drivers what safety gear (PPE) to wear.

The Transporter promises that all trucks are safe, licensed, and have valid discs as required by law.

Transporters must make sure their drivers have valid licenses and permits. These must be uploaded to the driver's profile.

Drivers must send a location update through the app at least once an hour while on a trip. If they don't, payments may be delayed.

Drivers must update their status (like 'Arrived' or 'Delivered') in real-time using the Co-Pilot app.

Drivers must wear the required safety gear at all sites. CargoXchange is not responsible for injuries if the driver doesn't follow these rules.

The Transporter is 100% responsible for any cargo loss or damage from the moment it is loaded until the delivery is signed for.

CargoXchangeSA does NOT provide backup or secondary insurance. Shippers must get their own extra cover if they need more security.

Shippers must check the Transporter's insurance documents on the platform before giving them the job.

We now pay carriers in 7 days after POD approval to ensure fast liquidity for transporters.

All payments are held safely by the platform. Money is only released after the 7-day checking period following delivery.

Shippers have 48 hours to check delivery photos and signatures before the 7-day payment timer starts automatically.

Fees for waiting apply after the free time is up. These must be claimed through the app.

You get 3 hours of free waiting time for loading and 3 hours for offloading as standard.

If a job is cancelled after it was booked, money is refunded but a small admin penalty may apply.

Users who break the rules or don't show up for a job may be banned from the platform.

Users may be invited to participate in our referral program. Any rewards or credits earned through this program are subject to specific promotional terms and are not exchangeable for cash. The program can be changed or stopped at any time without prior notice.

Advertisers must make sure their ads are honest and follow South African laws.

We follow the POPI Act to keep your information safe. We only use your data for business and security purposes.

Prices, routes, and client names on the app are secret and cannot be shared with anyone else.

The app code, logic, and icons belong exclusively to DAVIDSOLOMON (PTY) LTD.

We try to keep the app running all the time. We are not responsible for delays caused by network problems.

We can close any account that is found to be dishonest or fraudulent.

If a court finds one part of these rules invalid, the rest of the rules still apply.

These rules follow South African law. Any court cases will happen in Durban (KZN High Court).

These terms, our privacy policy, and the digital contract make up the full agreement between you and us.
